About Jason Burkhead

After spending 20 years in the USAF as a military police officer I was disappointed with the quality of police work I saw from other officers. There were too many mistakes made that compromised the rights of the suspect and the officers simply wrote around them in their report. That re-inspired me to go to law school so I could defend the rights of others. After lengthy experience in both criminal law and civil litigation, I committed myself to criminal defense. Thus, Burkhead Criminal Defense was born. My goal is to provide quality, affordable criminal defense representation. My background gives me extensive experience in evaluating police reports and evidence. I have been certified on most of the same tools and techniques used by local law enforcement including, portable alcohol systems, intoxilyzer, and National Field Sobriety Tests among others. As a former criminal investigator and major collision investigator I have the knowledge and eye for detail to find flaws in the police reports the prosecutors use to charge defendants.

Written by Michelle L. Behan Amicus Curiae (Latin for "Friend of the Court") refers to a brief that is filed by an interested, non-party to the matter under consideration. This is often done in cases where organizations and entities wish to provide the reviewing court with their point of view, be it social or public policy implications, or special interest agendas....

Keeping FSTs Out of a Trial

04/23/2025

Written by Neil Halttunen I want to address a common issue that DWI practitioners are facing, trying to keep FSTs out of a trial. One way is to take the position that FSTs are scientific evidence and make the prosecutor lay scientific foundation which they rarely can do. The HGN test was the result of several studies. See Generally Session 8 of...
