About Max A. Keller

Max Keller graduated from law school in 1997 and then clerked at the Minnesota Court of Appeals for 3 years, helping 3 judges research the law and draft their opinions. He then worked in the Minnesota Attorney Generals' Office for about 5 years, prosecuting DWI's and representing state agencies like the Department of Public Safety and its Driver and Vehicle Services Division. Max then went into private practice in 2003, where he has been protecting individual's rights for more than 17 years. His practice focuses exclusively on criminal and associated matter stemming from criminal accusations, such as vehicle forfeiture or forfeiture of other property, implied consent driver license revocation hearings, disciplinary hearings before licensing boards such as the Physical Therapy Board, the Nursing Board, the Medical Board, the Behavioral Health Board (which regulates Chemical Health assessors, amongst other professions), etc. as well as others hearings that come up as a result of criminal accusations, such as maltreatment appeals with the Dept. of Human Services and appeals and set-asides of Disqualifications by DHS. Max has won felony and non felony jury trials in DWI, domestic assault, and criminal sexual conduct cases thought the Twin Cities and Greater Minnesota. He also won the first felony DWI case that we know of to be reversed by the Minnesota Supreme Court. Max has litigated over 60 appeals in the Court of Appeals and the Supreme Court of Minn., and won a decision that the distribution of child pornography law was unconstitutional.

Keeping FSTs Out of a Trial

04/23/2025

One way is to take the position that FSTs are scientific evidence and make the prosecutor lay scientific foundation which they rarely can do. The HGN test was the result of several studies. See Generally Session 8 of...
