About Rawi Asghar
Rawi Asghar is a criminal defence lawyer with Aitken Robertson, recently called to the Ontario Bar in June 2025. Although newly licensed, his path to practice has been shaped by extensive hands-on experience with DUI matters. Rawi completed his articles at a high-volume criminal defence firm in downtown Toronto, where impaired driving cases formed the majority of his work. In the months leading up to his Call, he worked under a supervision agreement with Aitken Robertson, continuing to refine his skills in defending drinking and driving charges. Throughout his articling term and early practice, Rawi assisted senior counsel on DUI cases in a variety of capacities, including drafting Charter applications, reviewing disclosure, and preparing cross-examinations. He has participated in approximately ten DUI trials to date, most often as co-counsel, contributing to trial strategy and highlighting key legal and evidentiary issues for senior lawyers. One notable case involved a successful directed verdict after his cross-examination revealed that the Crown could not prove identification beyond a reasonable doubt—resulting in an acquittal and underscoring the importance of distinguishing between evidence and admissible evidence. While Rawi is currently managing his DUI files independently, he continues to collaborate with senior counsel on complex cases. His approach involves breaking down the elements of the offence, carefully scrutinizing the strength of the Crown’s evidence for each, and searching for Charter breaches that can be leveraged to seek a withdrawal, a reduction to careless driving, or to mount a full trial defence. He is particularly interested in the evolving landscape of DUI law, where advances in technology and legislative changes present both challenges and opportunities for the defence. Fluent in Farsi, Rawi works effectively with clients from diverse backgrounds, ensuring legal concepts are explained in plain language so clients can make informed decisions. He is in the process of joining the Ontario Bar Association and the Criminal Lawyers’ Association.
