Wayne Rodgers Foote Is Maine’s only Board Certified OUI Defense Law Specialist. He has successfully represented hundreds of people charged with crimes. His practice is limited to criminal defense in both state and federal court. He specializes in defending people charged with OUI and other drinking and driving offenses. Mr. Foote is a passionate defender of his clients and the Constitution. He is recognized as one of the best OUI defense attorneys in the State of Maine and the United States.
Mr. Foote was born in 1950, in Melrose, Massachusetts. He served in the United States Army for eight years as an electronic intelligence specialist and Russian linguist. He held the rank of Staff Sergeant and received an honorable discharge. Mr. Foote is a graduate of Colby College, Waterville, Maine, from where he graduated magna cum laude with a degree in history in 1983. He was elected to the Phi Beta Kappa honor society the same year. He received his Juris Doctor degree in 1986 from the University of Maine School of Law.
Mr. Foote has extensive training in OUI defense. He received Certificates of Achievement for successful completion of the National College for DUI Defense, Inc’s, Summer Sessions in 1998, 1999, 2000, 2001, 2003, 2005, 2006, 2007, 2008, 2010, 2011 and 2013; the 2006 and 2009 Winter Sessions; Mastering Scientific Evidence in DUI/DWI Cases in 2002, 2005 and 2015; Florida International University’s Breath Analysis Forensic Workshop in 2004; the National Association of Criminal Defense Lawyers’ DWI training session in 2005; the NHTSA/IACP Drug Recognition Evaluation Program in 2008; and Forensic Blood, Breath and Urine Testing Workshop in 2009. Mr. Foote is also certified to USDOT standards as a Maintenance Technician and Operator for the Intoxilyzer 5000 breath testing machine and the Intoxilyzer 8000 (the machine currently used in Maine.) In 2007, Mr. Foote became the first and only attorney in Maine who is Board Certified in OUI Defense Law by the National College for DUI Defense, Inc. He was recertified in 2012.
Mr. Foote is a Sustaining Member of the National College for DUI Defense, Inc. and was the College’s State Delegate for the State of Maine from 2000 to 2008. He is an NCDD Faculty Member, teaching at Summer Sessions in 2011 and 2013. Mr. Foote is also a Charter Member, past Vice President and a current Director of the Maine Association of Criminal Defense Lawyers. Mr. Foote teaches both in Maine and nationally at seminars for attorneys on the subjects of OUI defense, state and federal criminal defense and the Federal Sentencing Guidelines. He has lectured at the University of Maine in graduate level courses on the subjects of scientific evidence and the use of expert witnesses in criminal matters. Mr. Foote is admitted to practice before the United States Supreme Court, the United States Court of Appeals for the First Circuit, the United States District Court for the District of Maine, the State of Maine and the Passamaquoddy Tribal Court.
